Terms of Service & User Agreement
Effective Date: April 4, 2026
This User Agreement ("Agreement") is a legal contract between you ("User") and ModsNG ("the Platform"). By accessing, browsing, or using the services provided by ModsNG, you acknowledge that you have read, understood, and agreed to be bound by the following terms.
1. Scope of Service
ModsNG provides a digital hosting and communication platform for the BeamNG.drive modding community. We act as a "Service Provider" under the Digital Millennium Copyright Act (DMCA). We do not pre-screen all content and are not the authors of User-Generated Content (UGC).
2. User Warranties & Representations
By uploading any file (including but not limited to .zip, .pc, or .dae files) to ModsNG, you represent and warrant that:
- You own the intellectual property rights to the content or have obtained explicit permission from the original creator.
- The content does not contain malicious code, "backdoors," "IP loggers," or any software intended to damage or monitor a user's system.
- The content does not violate any third-party privacy rights or publicity rights.
3. Licensing & Distribution
When you upload content, you grant ModsNG a non-exclusive, royalty-free, perpetual, irrevocable, and sub-licensable right to host, cache, store, archive, index, and display the content for the purposes of operating the platform. This license does not transfer ownership; you remain the sole owner of your original work.
4. Prohibited Activities
Users are strictly prohibited from:
- Asset Flipping: Uploading content that is a 1:1 copy of another creator's work without modification or permission.
- Leaked Content: Distributing "Private" or "Paid" mods from other creators without authorization.
- Commercial Exploitation: Using ModsNG to advertise third-party products without prior written consent.
- Automated Access: Using scrapers, spiders, or crawlers to harvest user data or mod files.
5. Limitation of Liability & "As-Is" Clause
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MODSNG AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES. ALL CONTENT IS PROVIDED "AS-IS" AND "AS-AVAILABLE." WE DO NOT GUARANTEE THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
6. Indemnification
You agree to indemnify, defend, and hold harmless ModsNG and its administrators from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt (including attorney's fees) arising from your use of the platform or your violation of these terms.
7. Account Termination
We reserve the right, at our sole discretion, to suspend or terminate any account for any reason, including but not limited to a breach of these Terms, without prior notice or liability.
8. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the **Province of Quebec, Canada**, without regard to its conflict of law provisions.
9. Severability
If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
