Digital Millennium Copyright Act (DMCA) Notice & Policy
Effective Date: April 4, 2026
ModsNG ("the Platform") respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998, the text of which may be found on the U.S. Copyright Office website, ModsNG will respond expeditiously to claims of copyright infringement committed using the ModsNG service.
1. Notice of Alleged Infringement (Takedown Request)
If you are a copyright owner, authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Platform by completing the following DMCA Notice of Alleged Infringement and delivering it to our designated Copyright Agent.
Your Notice must include the following information:
- Identify the copyrighted work that you claim has been infringed.
- Identify the material or link you claim is infringing (the URL of the mod on ModsNG).
- Provide your full legal name, mailing address, telephone number, and email address.
- Include a statement that you have a "good faith belief that use of the copyrighted material is not authorized by the copyright owner, its agent, or the law."
- Include a statement that the information in the notification is accurate, and under penalty of perjury, that you are the owner or authorized to act on behalf of the owner.
- Provide your electronic or physical signature.
2. Counter-Notification Procedures
If you believe that your content was removed by mistake or misidentification, you may file a counter-notification with us. Upon receipt of a valid counter-notification, we may reinstate the content in question unless the complaining party files a court order against you. To be effective, a Counter-Notice must be a written communication that includes the following:
- Identification of the material that has been removed and the location at which the material appeared before it was removed.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, and telephone number.
- A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of Canada/USA, for any judicial district in which ModsNG may be found.
3. Repeat Infringer Policy
ModsNG maintains a strict "Repeat Infringer" policy. Accounts belonging to users who are found to have uploaded infringing content on more than three (3) separate occasions will be permanently terminated. This includes the forfeiture of all uploaded content and the blocking of associated IP addresses and hardware signatures.
4. Converted Assets & Car Brands
ModsNG acts solely as a passive conduit for the distribution of user-created content. We do not verify the licensing of 3D assets, car brand logos, or textures prior to upload. However, we will act immediately upon receiving a formal request from a manufacturer or original asset creator.
